Child Custody Laws
Child Residence & Custody
A residence order determines where a child shall live. It normally lasts up until the child is 16 years old. It some cases it can extend beyond this and if it is in the child’s best interest.
A child custody residence order also provides the carer with parental responsibility for the child. This could include, for example, a grandparent.
Where a residence order is in force it also means that no-one can take the child outside of the jurisdiction of England & Wales for more than one month without the consent of everyone who has parental responsibility for the child or with the court’s permission.
