Divorce Procedure

Most divorces are undefended (which means that the other party is not contesting the divorce). The steps are usually:

  • The person requesting a divorce completes a divorce petition (and a form about any children);
  • The court send out an acknowledgment form for the other person to complete;
  • Steps are then taken to:

    • the Decree Nisi (the interim divorce order);
    • a legal ‘cooling off’ period for at least six weeks and one day; and
    • the Decree Absolute (the final divorce order).

There is often no need for anyone to attend court for the divorce. It usually takes about four to six months to complete. Our divorce flow chart provides some useful information about the process. However, the overall timescale can be longer where there are other issues, for example, to resolve the matrimonial finances and/or anything to do with the children.

Extra care must be taken where the case has an international element to it because there could be more than one country where the divorce could start.
